Addressing fathers' rights in Florida

As a father, you may be concerned that family courts in the state will be predisposed to favor your child's mother in custody and support decisions. Although there may be biases at times, there is also an understanding that a child may benefit from the ability to develop a meaningful relationship with both parents. The ability to articulate the significance of this relationship as it relates to your child's development may be helpful in obtaining an outcome that ensures your continued involvement in your child's life.

A parenting plan is a significant point of focus, a definition of specific ways in which each parent will be involved in the decisions related to a child's care, health and education. A parenting plan typically also details parenting time for each party. Approaching this phase of your case with clear goals may help, and strong legal support may be an important part of communicating your interests effectively.

In cases of unwed fathers endeavoring to exercise their rights, the establishment of paternity is necessary. Although the simplest approach to doing so is through an affidavit of paternity being legally executed by both parties, refusal of a mother to execute such an affidavit does not prevent you from moving forward to request paternity testing. Your legal counsel may help in articulating your desire to provide for your child's well-being through health care coverage, rights of inheritance and relationship-building. In cases involving the potential adoption of your child, prompt action may be necessary to exercise your rights as a father.

Because each case is handled in accordance with a father's unique situation and goals, it is important to deal with your own concerns and interests in person as you seek counsel in deciding how to proceed. You can learn more by reviewing our fathers' rights page.
