Can Stay-At-Home Dads In Florida Receive Alimony?

When most people think of alimony, they think of support payments a woman may receive from her ex following their divorce. However, Florida's alimony statute is gender neutral. This means that men and women may receive alimony.

In Florida, the court considers a number of factors in determining whether there should be an award of alimony, including whether one side has a financial need and the other has the ability to pay. In the case of stay-at-home dads, many have sacrificed their own careers and earnings potential to enable their partners to pursue their careers. As a result, stay-at-home dads may be entitled to alimony if their marriage ends in divorce.

There are four types of alimony in Florida:

· Bridge-the-gap alimony to allow the recipient to make a transition from being married to being single

· Rehabilitative alimony to assist a recipient in becoming self-supportive

· Durational alimony for a specific period of time

· Permanent alimony

In addition to financial need, the court considers a number of other factors in determining whether one side should receive alimony, including:

· The standard of living established during the marriage

· How long the marriage lasted

· The ages and conditions of each party

· The financial resources available to each party

· The earning capacity of each party

· The contributions of each party to the marriage, including child care

· The responsibilities each party will have for minor children
