In a twist that might interest some Florida residents, rapper DMX joked about another man whose name is also Earl Simmons receiving an order for paternity testing from the child's mother. DMX, who recently served a prison sentence for failing to pay child support in a separate child support case, said he is in no great hurry to clear up the current matter.
Reportedly, DMX has admitted the child for whom the paternity testing has been demanded is his and not those of Mr. Simmons. Upon learning about the apparent mix-up, the rapper just laughed and suggested that the court order Mr. Simmons to pay child support for the child DMX has already claimed as his own.
The less-famous Mr. Simmons, who lives in Massachusetts, was reportedly shocked when he received the paternity demand from the child's mother, who lives in Florida. DMX, apparently thinking it was funny, stated the man should go to jail for not paying, even though the child is not Mr. Simmons'. There is no word on how the mix-up occurred or what is being done to rectify it.
While the paternity of unmarried fathers must be established in order for the father to assert child custody rights or to be ordered to pay child support, establishing paternity does not always have to occur through genetic testing. When a father acknowledges a child as his own and that acknowledgment is not challenged by the mother, the father will then be recognized as the parent and will be able to assert his rights to have visitation with his child. If a father needs to establish paternity in order to gain his child custody rights, he may want to seek help from a family law attorney.
