A paternity dispute in Florida can cause problems for all of the participants. Until it is settled, there can be multiple disagreements over fathers' rights, child support and custody. In some cases, there can be mistakes made, muddling the situation even further. Such a thing occurred with a man who happens to share the same real name as the rapper DMX.
A man by the name of Earl Simmons, who lives in Massachusetts, received documents in the mail regarding paternity and was ordered to pay child support. The problem was that the order was intended for the Earl Simmons who goes by the name DMX. The court in Florida mistakenly sent the order to the Mr. Simmons in Massachusetts instead of DMX. The order was for DMX to make his monthly payments to his ex-girlfriend to pay for their two children.
The Massachusetts Mr. Simmons has two children and was required to take a paternity test to prove DMX's children are not his. DMX had technically been paying his ex-girlfriend to care for the children without documenting it. They chose to go through the legal channels to show that he was adhering to the law and receive credit for behaving appropriately to prevent another legal entanglement that could land him back in jail.
While this is little more than a case of mistaken identity that engulfed two men who had nothing to do with one another, it is just an example of the difficult nature of paternity matters. If there is a paternity action necessary, it is important that the putative father is represented by experienced legal counsel to fully protect his rights.
