Many divorce disputes — even those in which the parties have serious differences — can be resolved out of court through mediation.
Mediation offers both of you the benefit of legal counsel. Both of you meet with a neutral third party, a trained and certified mediator, with your attorneys at your sides and seek to work out the details of your divorce agreements.
It can be less expensive than litigation, far less adversarial, and the agreements are confidential and private. Additionally, the possibility of unpleasant surprises in the courtroom is eliminated as the parties are able to discuss their issues in private. This allows you to come up with creative solutions that take into consideration your unique circumstances.
Florida Requires Mediation
The Florida Family Law Rules of Procedure require parties to a divorce to go to mediation both before temporary relief can be granted and before a final hearing (trial) can be held in the case. The judge has the power to waive the mediation requirements but is generally reluctant to do so unless there are special or unusual circumstances.
